What are the grounds for appealing a judge’s decision?

In Washington, there are many grounds that someone can appeal a judge’s decision in appellate law. Generally, an appellant must prove that the original court’s decision was incorrect or that the outcome was unfairly influenced by one or more factors. These grounds can include errors in the application of the law, factual errors, errors in interpreting the evidence, inappropriate handling of testimony, and failure to recuse, among other issues. The appellant must also be able to prove that the error was not something minor or insignificant. That is, the court must have made an obvious mistake or committed an obvious injustice. In some cases, the appellant may be able to convince the appeals court that the lower court made a mistake even if the mistake was not obvious. It is important to note that appellate courts generally do not re-examine witness testimony or evidence. That is, they will not consider new evidence or testimony that was not presented during the original trial. Instead, they will focus on the original proceedings and decide if any error occurred that could have resulted in a different outcome. In Washington, the appellate court will also consider if the lower court applied the law correctly and if the decision was fair. This includes making sure that the decision is consistent with both the applicable laws of the state and applicable case law. If any of these elements are found to be incorrect, the appellant may be successful in appealing the decision.
