What is the process for obtaining an appellate court’s review of a jury verdict?

In Delaware, obtaining an appellate court’s review of a jury verdict is a process that consists of several steps. When a jury reaches a verdict, the court must enter the verdict as a court order. If either the plaintiff or defendant disagrees with the outcome they may appeal the jury’s decision to a higher court. In order to do this they must first submit legal documents called briefs. These briefs explain why the jury’s verdict should be overturned and what their argument is, citing relevant cases to strengthen their argument. Next, the court will set a date for oral arguments. During oral arguments, legal counsel from both parties will present their case before the appeals court. Once they are finished, the court will allow the other party to respond. After this, both parties will have a chance to ask questions and the court will ask its own questions. Once all arguments have been heard, the court will issue its own decision. This decision may or may not overturn the jury’s verdict. If the court agrees with the plaintiff or defendant, it will issue a new verdict. If not, the jury’s verdict will stand. This decision will be binding on both parties and cannot be appealed again.
