What is the standard of review for an appellate court’s interpretation of a statute?
In Mississippi, the standard of review for an appellate court’s interpretation of a statute is de novo. This means that the appellate court independently reviews the trial court’s interpretation of the statute. The court will determine what the statute means and then determine if the trial court’s interpretation of the statute is correct. The appellate court must consider every part of the trial court’s decision, and any relevant evidence, law, or regulations. In other words, the appellate court looks at the entire case and makes its own determination—based on its own interpretation of the statute—as to whether the trial court’s decision was correct. When determining the correct interpretation of a statute, the appellate court will consider the context in which the statute was written. The court will also take into account the purpose of the statute, as well as any case law that may be relevant. If there is ambiguity in the language of the statute, the court may also consider how other courts have interpreted similar statutes. In cases where the appellate court disagrees with the trial court’s interpretation of the statute, it will overturn the decision. The court may also modify, reverse, or affirm the decision, depending on the specific facts of the case.
