What kind of relief can be sought from an appellate court?

In Nebraska, an appellate court is a court that hears appeals from lower courts and reviews cases to determine if there was a legal error made in the decision-making process. Appellate courts are the highest level of courts in a state, and an appeal is commonly made when someone believes a lower court’s decision was wrong or unjust. When a case is appealed, a person or group seeking relief from the decision of a lower court files a brief (written argument) detailing why the court’s decision was in error. The appellate court then reviews the briefs and hears oral arguments before making its own decision. Depending on the case, relief from the appellate court can include overturning the decision of the lower court, ordering the lower court to reconsider its decision, ordering a party to do something, or ordering the parties to pay damages. If the appellate court overturns a lower court’s decision, it can order a “remand”, which sends the case back down to the lower court with instructions on what to consider and how to proceed. An appellate court can also “affirm” a lower court’s decision, which keeps the original decision in place. In this case, the parties may be barred from further appealing the decision. It’s important to keep in mind that an appellate court is not a fact-finding court and only looks to see if the lower court followed legal procedures correctly.
