Are there limits to the amount of attorney’s fees that can be awarded by an arbitrator?

In Kansas, there are limits to the amount of attorney’s fees that can be awarded by an arbitrator. Under Kansas law, attorneys’ fees can only be awarded to a party that prevails in an arbitration proceeding when such fees are provided for in an agreement between the parties. Therefore, when the parties have agreed that the prevailing party will be entitled to attorneys’ fees, it is up to the arbitrator to determine the appropriate award. In addition, the amount of attorney’s fees awarded by the arbitrator must be reasonable in order to be enforceable. The reasonableness of the award will be based on several factors, such as the complexity of the dispute, the quality of the attorneys’ work, and the amount of time spent working on the case. Additionally, the arbitrator may consider the fees charged by other attorneys in similar circumstances, and the nature and results of the dispute, in order to determine the reasonableness of the award. Finally, the arbitrator may not award attorneys’ fees that exceed the actual fees paid by the parties to their respective attorneys. If a party has paid less to its attorney than what an arbitrator has awarded for attorney’s fees, it can be challenging to enforce such an award since the opposing party will be unable to collect the difference from the prevailing party’s attorney. Therefore, it is important for parties to enter into arbitration with an understanding of the limits of attorney’s fees that may be awarded.
