What remedies can an arbitrator award?
In South Carolina, an arbitrator can award a variety of remedies to resolve a dispute. These remedies are typically governed by the terms of the arbitration agreement, but they may also be allowed by applicable statutes or the common law. An arbitrator in South Carolina is authorized to grant monetary relief for breach of contract, negligence, or other wrongful acts as well as damages for emotional distress, mental anguish, or punitive damages. Monetary relief may include compensatory damages for injury or harm suffered as a result of the dispute, restitution for compensation of a wrongful taking or diversion of money, and/or punitive damages for egregious circumstances. In addition to monetary remedies, an arbitrator may also be empowered to grant injunctive relief which is an order from the court which requires someone to do or stop doing something. An injunction is typically used to prevent further harm or injury to a party and may include barring a person from a specific area, halting a sale or other transaction, or preventing or requiring the performance of certain tasks. Finally, an arbitrator can award specific performance which is a form of equitable relief ordering someone to fulfill a contract or other obligation. This may include ordering someone to complete a job, deliver goods or services, deliver property, or perform any other required act or service.
