A Motion to Stay Proceedings Pending Arbitration is a legal procedure used when two parties are involved in a dispute and agree to resolve the dispute through arbitration instead of in court. In this situation, the party filing the motion will ask the court to stay or delay all other proceedings in the case while the parties resolve the dispute through arbitration. In Iowa, this motion is governed by the Iowa Arbitration Act. According to this law, the court must grant a stay if the parties have agreed to proceed to arbitration and a valid arbitration agreement is in place. The motion must include a copy of the arbitration agreement and any other documents that support the stay.
