What is an interlocutory appeal?

An interlocutory appeal is a type of legal appeal in arbitration law that occurs during the middle of an arbitration case. In Oregon, an interlocutory appeal is typically used when the arbitration case is particularly complex or a decision made pre-trial needs to be reviewed. In an interlocutory appeal, the court or other reviewing body will hear both parties of the case present arguments and evidence in their favor. The court will then issue a ruling on the issue, which can either be affirmed or reversed. Depending on the jurisdiction, the ruling may become part of the trial record and be considered by the arbitrator when rendering a decision at the end of the trial. In Oregon, an interlocutory appeal can be especially advantageous for those involved in complex cases. For example, in a situation where the arbitrator has made a decision about a controversial topic that could impact the outcome of the trial, an interlocutory appeal allows the parties to get an early ruling on the issue without having to wait until the end of the trial. It also allows them to present their arguments and evidence to the court before the final verdict is reached. Overall, an interlocutory appeal is an important tool in arbitration law in Oregon and other jurisdictions for providing an early review of an issue and helping parties resolve disputes.
