What is a summary judgment in arbitration?

A summary judgment in arbitration is a decision made by an arbitrator or arbitration panel about a case, without requiring a full trial or hearing. The arbitrator or panel will review the evidence presented and make a judgment based upon that evidence. The decision is binding, just as a court ruling would be, and the parties involved cannot proceed to a trial or further appeals. In District of Columbia, summary judgments in arbitration are strictly governed by the District of Columbia Arbitration Law. The statute lays out the standards for when a summary judgment can be granted. Generally, the process looks at whether there are genuine issues of material fact and whether the moving party is entitled to judgment as a matter of law. If the parties have agreed to a specific process for summary judgment in their contract, then that process may be used instead of the standard set out in the D.C. Arbitration Law. A summary judgment is a useful tool in arbitration because it allows the parties to resolve their dispute quickly and without the expense of a trial. It is important, however, that the parties receive the procedural protections afforded by the D.C. Arbitration Law. All parties involved must be notified of any summary judgment motion and given a chance to respond. In addition, the summary judgment must be made on the basis of the evidence presented, and the arbitrator must provide an explanation of his or her reasoning.
