What is an arbitration award?

An arbitration award is a decision made by an arbitrator or a panel of arbitrators appointed to resolve a dispute. In South Carolina, arbitration is an alternative way of resolving a dispute without going to court. An arbitration award is a legally binding decision that is issued after both parties have had a chance to present their case and the arbitrator has heard all of the evidence. The arbitrator then reviews the evidence and makes a decision based on the evidence and the applicable law. At the conclusion of the arbitration, the arbitrator will issue an award that sets out the terms of the decision, which can include orders to pay money, provide goods or services, and/or perform specific actions, such as hiring or reinstating someone to their job. The award is like a court order in that the parties to the arbitration are legally required to comply with it. If one of the parties does not comply with the arbitration award, the other party can seek to have it enforced in court. The court will enforce the award just like it would enforce a court order. To be legally enforceable, the arbitration award must be in writing, signed by the arbitrator, and must include the reasons for the decision. It must also be timely—issued within the time set out by the contract or agreement that set up the arbitration.
