How is an arbitration award enforced?

Once an arbitration award is made, it will be enforced by a court in Washington unless the parties to the dispute have agreed in advance that the award is not to be enforced by a court. In order for the court to enforce the award, a party must file a motion for an Order of Confirmation. The court will review the award to ensure that it is not contrary to public policy and then will enter the Order of Confirmation. Once the Order of Confirmation is entered, it has the same force and effect as any other court judgment. The party against whom the award is entered will be compelled to comply with its terms unless they can show that there was misconduct in the arbitration or some other ground to set aside the arbitration award. In addition, the court may issue other orders such as a writ of execution or an injunction to help enforce the arbitration award. A writ of execution is an order to seize the property of the other party to the dispute in order to satisfy the award. An injunction is an order to prevent the other party from taking certain actions to disobey the award. Finally, in some cases, a party’s failure to obey the terms of an arbitration award can be treated as contempt of court. This means that the court can impose sanctions such as fines and jail time on the party that refuses to comply.
