How do I challenge an arbitration award?
In California, challenging an arbitration award can be done by filing a petition in the court where the arbitration took place. The challenger must have a valid legal reason for the challenge. Legally, the award may be challenged for reasons such as fraud, corruption, misconduct, or the failure of the arbitrator to follow the law. The party challenging the arbitration award must provide evidence to support their challenge in their petition. Another reason to challenge an arbitration award is that the arbitration was decided incorrectly. The party challenging the award must provide the court with evidence to show that the arbitration was decided differently than it should have been. Additionally, the challenger must provide evidence that the award was made without jurisdiction (i.e., the arbitrator had no authority to make the decision). To begin the process, the challenger must file a Petition to Set Aside, Vacate, or Correct the Arbitration award with the court. The petition must include the name of the arbitrator and the date of the arbitration. Once the petition is filed, the court will evaluate the petitioner’s evidence and decide whether or not to set aside or vacate the award. The court can also modify or correct the award based on the evidence presented.
