Can an arbitration award be annulled?
In Kansas, an arbitration award can indeed be annulled. An annulment of an arbitration award happens when a court in the state finds that the arbitration process itself was not conducted in a fair or legal manner, or the result of the arbitration was not supported by the facts or the law. A person seeking an annulment of the arbitration award must file a petition in court, along with supporting evidence, to demonstrate that the arbitration process was flawed. This evidence must prove that some element of the proceedings was so unfair, illegal, or contrary to the facts or law that the outcome of the arbitration is void. The court in Kansas will then review the petition and the evidence, and decide whether or not the arbitration award should be annulled. If the court grants the annulment, the arbitration award will be vacated and the dispute will need to be resolved in a different way.
