How do I challenge an arbitration award in court?
Challenging an arbitration award in court is a legal process that must be properly followed to be successful. In Florida, a petition to challenge an arbitration award must be filed in the circuit court of the county in which the arbitration hearing occurred. The petition must include all the evidence presented at the arbitration hearing, a statement of the award, and the grounds on which the award is being challenged. The grounds for challenging an arbitration award are limited. Generally, the petitioner must show that the arbitration procedure was fundamentally unfair, that the arbitrator exceeded their powers, or that the award was entered improperly. For example, a petitioner might challenge the award if the arbitrator showed bias towards one of the parties, or if the arbitrator failed to consider all of the evidence presented in a meaningful way. In order to be successful, the petitioner must show that the award was erroneous. The petitioner may also ask the court to modify the arbitration award to make it reasonable and enforceable. Once the petition is filed, the court may grant an injunction to set aside the award temporarily while the court reviews the case. If the court finds that the award should be overturned or modified, it can issue a judgment on the arbitration award. The judgment is then enforced by a court order and has the same force as if it had been decided by a court in a civil proceeding.
