Can arbitration awards be modified?

Yes, arbitration awards can be modified in California. In general, arbitration awards are only modifiable if both parties involved in the arbitration process agree to the modification. If either party does not agree to the modification, then the award may not be changed. The California Code of Civil Procedure governs the modification of arbitration awards. Under this code, an award may be modified if there was a miscalculation of law, facts, or figures, or if there was a mutual mistake in the formation of the award. Additionally, parties may be allowed to modify parts of the award if they can prove that there was some type of mistake or misconduct involved in the formation of the award, or if they can show a clear error of law. In some cases, a court or judge may also be able to modify or set aside an arbitration award if there is evidence of unfairness, corruption, or fraud. The party requesting the change must be able to demonstrate that a mistake or improper conduct affected the outcome of the original award and that the modification is necessary to correct the mistake or improper conduct. In general, arbitration awards are difficult to modify because they are often intended to be final and binding. If the parties involved cannot agree to a modification or if a court or judge determines that no reasonable grounds exist for a modification, then the original award will remain in effect.
