Can arbitration awards be modified?

Yes, arbitration awards can be modified in Pennsylvania. The Pennsylvania Uniform Arbitration Act which governs arbitration awards in Pennsylvania allows for modification of the awards under certain circumstances. In Pennsylvania, an arbitrator is allowed to modify an award upon the joint motion of the parties involved in the arbitration proceeding. This joint motion must be filed within 30 days of the award’s issuance. The motion must contain a statement of the award that the parties wish to modify and the modifications they would like to make. When a court is asked to modify the arbitration award, the court will consider if the award is recoverable, legal, and correct. The court will also consider if both parties to the arbitration proceedings consented to the modifications. When a court is asked to modify an arbitration award, the court may grant the motion as long as it finds that the modifications do not violate the original agreement the parties made when they agreed to arbitration or any applicable law. Lastly, there are certain circumstances in which a court can modify an arbitration award without the joint motion of the parties. These include if a court finds that the award was illegally procured, or if the award is incomplete, ambiguous, or conflicts with any applicable law.
