What is a motion to vacate, modify or correct an arbitration award?

A motion to vacate, modify or correct an arbitration award is a legal action that can be taken in South Carolina to challenge a previously decided arbitration award. Arbitration is a form of alternative dispute resolution (ADR) in which a neutral third-party known as an arbitrator hears both sides of a dispute and renders a decision. An arbitration award is the arbitrator’s decision about the dispute, and it is supposed to be legally binding upon both parties. However, if either party believes that the award was unjust or wrong in some way, they can file a motion to vacate, modify, or correct the award. This motion must be filed in the court of Common Pleas in South Carolina. The court will review the motion and decide whether or not to grant it. If granted, the court will issue an order vacating, modifying, or correcting the award. The court will only grant a motion to vacate, modify, or correct an arbitration award if it can show that there was some kind of legal error, fraud, mistake, or other injustice associated with the award. For example, the court might find that the arbitrator failed to follow the correct procedures or that the decision was based on incorrect evidence or law. It is also important to note that the court will not overturn the award on the basis of the parties’ disagreement with the decision. The motion must be based on legal grounds.
