What is patent law?
Patent law is a branch of the law that grants exclusive rights to an inventor for their product or invention. In Alabama, patent law is governed by the United States Patent and Trademark Office (USPTO). Patent law can be broken down into three main categories: utility patents, design patents, and plant patents. Utility patents protect a product or invention for its function and its use case. Design patents protect the physical appearance of a product or invention. Plant patents protect newly developed varieties of plants. In order to be granted a patent, an invention must meet certain criteria. The invention must be novel, new, and nonobvious. Additionally, the invention must be useful, and it must be able to be reproduced. Once an invention meets the criteria, the inventor can file a patent application with the USPTO. The USPTO will examine the application and decide whether or not to issue a patent. If the patent is approved, the patentee will be issued a patent right that will grant them exclusive rights to the invention. These exclusive rights can include the right to make and sell the invention. They also allow the patentee to sue anyone who infringes on their patent rights. In this way, patent law encourages innovation and ensures that inventors are properly compensated for their work.
