What is an artist’s resale royalty?

An artist’s resale royalty is a type of copyright protection for artists in Wisconsin. It is also known as the “visual artist’s right of resale”. This law was established in order to protect the financial interests of the artists whose work is resold. It entitles the artist to receive a percentage of the profits from any resold artwork. The resale royalty is based on the resale price of the artwork and the artist’s percentage is determined by the type of artwork. For instance, for an original painting, the artist would receive 5% of the resale profits, whereas for a digital work the royalty is 7%. The resale royalty applies to any artwork that has been sold at least once before and is now being sold for a second time. The artist must register with the state and complete certain paperwork in order to receive the royalty. Furthermore, the law establishes that the artist must be the original creator of the artwork and must have been a resident of Wisconsin at the time it was created in order to be eligible for the resale royalty. In sum, an artist’s resale royalty is a type of copyright protection that entitles the artist to a percentage of the profits from any artwork they created that is resold. It is based on the resale price and the artist must meet certain requirements in order to receive the royalty.
