What is an infringement of trade secret law?
Trade secret law, or “misappropriation” laws, are laws that restrict the misuse of confidential information, such as secret formulas, techniques, processes, or inventions. In Kansas, trade secret law protects trade secrets from being misused or stolen. An infringement of trade secret law occurs when someone unlawfully obtains, discloses, or uses another’s trade secret. Infringement may also occur when someone has reason to know that the trade secret was obtained improperly or wrongfully disclosed. Infringement is a serious violation of trade secret law. It can lead to costly civil lawsuits, as well as subject violators to criminal penalties. Furthermore, trade secret infringers may be liable for the trade secret owner’s attorney fees and costs, as well as any profits the infringer has made due to the unlawful use of the trade secret. In order to protect trade secrets, it is important for businesses to take steps to ensure that their trade secrets remain confidential. Businesses should have strong contracts with employees and third parties that expressly state that the trade secret will remain confidential and that the employees or third parties will not use or disclose the trade secret without authorization. Additionally, businesses should employ industry standard security measures to protect trade secrets from accidental disclosure or unauthorized use.
