How do I file a copyright infringement lawsuit?

In Oregon, any person who believes their copyrighted work is being infringed upon can file a lawsuit against the infringer in Federal Court. This is known as a copyright infringement lawsuit. Before filing a copyright infringement lawsuit, the copyright owner should begin the process by providing the infringer with a “cease and desist” letter that clearly outlines their copyright interests, the infringement, and the demand that it cease. This letter should be sent via certified and regular mail, as well as email if it is available. If the infringer does not respond to the cease and desist letter or fails to stop taking action that infringes on the copyright, the owner can file a lawsuit in the United States District Court. The lawsuit must include specific details about the infringement, such as the name and address of the infringer, a description of the copyrighted work, and the date the infringement occurred. The copyright owner can then request an injunction from the court to immediately stop the infringing activities, and to award them damages. If the court finds that the person has willfully infringed on the copyright, the infringing party will be required to pay the copyright owner statutory damages, as well as their attorney fees. Once the lawsuit is filed, the court will decide whether to grant the injunction and the amount of damages and attorney fees the infringer must pay. If the copyright owner wins the lawsuit, the court will issue a judgment against the infringer, and the infringer will be required to comply with the court’s orders.
