What is the public’s right of access to artwork?
In South Carolina, the public has a right to access artwork as protected by Art Law. This access is guaranteed under the Visual Artists Rights Act of 1990 (VARA), which is a federal law that protects the rights of creators of artworks. The VARA gives an artist the right to have their work displayed and viewed in its original form, protecting them from having their work modified in any way without their permission. It also protects artworks that are of “recognized stature” from damage, alteration, or destruction, and grants the artist the right to be connected to and receive credit for their work. The public has the right to access artwork in public spaces or an open forum such as exhibitions or displays. This right of access also includes the preservation of artwork in public collections, such as those found in museums and galleries. The public has the right to access artwork that is displayed in public places and to have their freedoms of speech and expression respected when viewing the artwork. Additionally, the public has the right to reproduce, distribute, or obtain artwork in digital or analog form if it has been made available to the public (with proper credits given). Overall, public access to artwork is protected by Art Law in South Carolina. This law ensures that both the artist and the public’s rights are respected while also safeguarding artwork from potential modification or destruction.
