What is an economic tort?

An economic tort is a kind of civil wrong that occurs when a person, or group of people, suffer economic damage due to another person’s action, or lack of action. In the state of Colorado, economic tort law generally applies to cases of fraud, interference in contractual or economic relationships, and wrongful appropriation of trade secrets. Tort law is a broad and developing area of law that provides a legal remedy for economic losses and other damages incurred by a person who has been harmed by another’s conduct. In the context of art law in Colorado, the most common economic torts are misappropriation of trade secrets, copyright infringement, trademark infringement, and commercial defamation. Misappropriation of trade secrets involves the wrongful acquisition of a trade secret, such as a proprietary formula or technique, from another person or entity. Copyright infringement occurs when someone uses or copies someone else’s original artwork without permission. Trademark infringement involves the unauthorised use of a trademark protected by law, such as a logo or signature. Finally, commercial defamation is the act of spreading false or defamatory information about a business or product in order to damage its reputation or cause financial harm. In Colorado, economic torts are governed by both federal and state laws. To prove an economic tort, the plaintiff (the person filing the lawsuit) must demonstrate that the defendant (the person being sued) caused them to suffer financial losses, that the losses were the result of a wrongful action, and that the wrongful action was the direct cause of the economic damage.
