What is an exclusive license?

An exclusive license is a legal agreement between an artist and a licensee (someone who has permission to use the artist’s work) in which the licensor (the artist) grants the licensee the exclusive right to use the artist’s copyrighted work. In Hawaii, an exclusive license grants the licensee the right to make copies and distribute the artwork worldwide, and also to create any derivative works based on the artist’s original design. The licensee is the only person or entity allowed to make use of the artwork under the terms of the agreement. The licensor is expected to receive royalty payments for the exclusive use of their work. This type of agreement is important for protecting an artist’s work from being copied or misused without their permission.
