What is an exclusive license?

An exclusive license is a type of copyright license granted by a copyright holder for a specific task or purpose. In Washington, an exclusive license grants the licensee exclusive rights to use a copyrighted work in one or more specific ways. For example, an exclusive license might grant the licensee the exclusive right to reproduce, distribute, publicly perform, or display a copyrighted work. In general, exclusive licenses are considered to be more valuable than non-exclusive licenses. That is because exclusive licenses give the licensee complete control over how the work is used and how it is monetized. Additionally, exclusive licenses may prevent other users from exploiting the work, even if they have obtained the copyright holder’s permission. An exclusive license is granted through a contract between the copyright holder and the licensee. This contract will usually detail out the scope of the license and the specific rights that the licensee has. For example, the contract may specify that the licensee has the right to reproduce the work a certain number of times or that the licensee can only market the work in a certain geographic region. To help protect the copyright holder’s rights, the licensee should pay careful attention to the agreement, as any violation of the license could result in legal action and liability. Furthermore, the copyright holder should also ensure that their rights are adequately protected by considering the scope of the license, the contract terms, and any potential areas of dispute.
