How are disputes between artists and buyers of artwork resolved?

In North Dakota, disputes between artists and buyers of artwork are typically resolved through private negotiation, mediation, or arbitration. Private negotiation is the informal process of the two parties coming to an agreement without involving an outside party or a court of law. This is often the quickest and most cost-effective way to reach a resolution. If private negotiation does not resolve the dispute, the two parties may choose to use mediation to reach a resolution. In mediation, a neutral third-party mediator facilitates the discussion between the two parties in an effort to reach a mutually agreeable resolution. If mediation does not resolve the dispute, either party may opt to pursue arbitration. In arbitration, an arbitrator hears the claims of both sides and issues a binding decision to resolve the dispute. The arbitration process is much like a trial, with each side presenting evidence and witnesses and making arguments to support their case. Finally, if no resolution is reached through the above methods, the dispute may need to be taken to court. In court, a judge or jury will hear the evidence, examine the contract between the two parties, and issue a judgment on the matter. The judgment is legally binding, and can be enforced using the court’s enforcement procedure if necessary. No matter which method is chosen to resolve the dispute, art law in North Dakota requires that both parties act in a fair and reasonable manner to try and resolve the dispute in the most amicable way possible.
