How are disputes between artists and buyers of artwork resolved?
In Kansas, when a dispute arises between an artist and a buyer of artwork, the parties may have a variety of options for resolving the dispute. One form of dispute resolution available to the parties is negotiation. In this approach, each side will listen to the other’s point of view and try to come to an agreement on a resolution of the dispute. This can be beneficial because the parties have a say in the resolution, and the outcome is likely to be more satisfactory for both sides than if the dispute is decided in court. If negotiation is not successful, the parties may decide to use arbitration or mediation. These are alternatives to traditional litigation and can provide faster resolution of disputes. In arbitration, a neutral third-party makes a decision about the dispute and the parties must abide by it. In mediation the parties come together and try to negotiate a resolution, with the help of a mediator. Finally, the parties may decide to go to court, although this is usually a last resort. Depending on the dispute, the case may be heard in a small claims court or in a civil court. The court will consider the evidence presented by each side, including any contracts or agreements between the parties, and then render a decision. The court’s decision is legally binding on the parties, although they may also appeal the decision if they are not satisfied with the outcome.
