What is an ‘alternative dispute resolution’?

Alternative dispute resolution (ADR) is a process used to resolve legal disputes without going to court. It is a less formal and often cheaper way to resolve disputes than a traditional trial. ADR options include mediation, arbitration, and negotiation. Mediation is when a neutral third-party mediator is brought in to help both sides of a dispute come to a mutually agreeable solution. The mediator is a neutral facilitator and is not there to make any decisions for the parties involved. Arbitration is a process where a neutral third-party arbitrator is brought in to hear both sides of a dispute and then make a binding decision based on the facts presented. Negotiation is a process used to try and resolve a dispute between two parties, usually without the help of a third-party. Negotiations usually involve the parties attempting to reach an agreement with each other that both parties are happy with. In Oregon, ADR is a common way to resolve art law disputes. ADR is often seen as an effective way to resolve disputes between art buyers and sellers, or between galleries and collectors. ADR can help expedite the resolution of art law disputes, and it can be less costly than a traditional court trial, making it an attractive option for those looking to settle disputes quickly and economically.
