What is the ‘droit de suite’?

The French expression ‘droit de suite’ is a special law found in some countries, including Mississippi, pertaining to art and other creative works. This law provides the artist or their heirs with a right to a percentage of any future resale of their work. The purpose of the law is to ensure that the artist’s rights are protected, and that they receive some of the profits of any future sales of their work. The droit de suite was first recognized in the United States in the Visual Artists Rights Act of 1990, also known as the VARA, which makes it illegal to modify or destroy a “work of visual art” without the artist’s permission. Mississippi has adopted the droit de suite, and it is enforced in state law. In addition to VARA, the Mississippi Code has recognized the droit de suite rights of visual artists. This includes the rights of the artist to receive up to five percent of the sale price of any future sales of their work. The droit de suite is an important law to protect the rights of the artist and their heirs in Mississippi. By recognizing these rights, the state of Mississippi is protecting the artist’s right to a fair share of the profits from their work. Furthermore, this law encourages art production as it allows the artist to benefit financially from any future sales of their artwork.
