What is asbestos litigation?
Asbestos litigation is a legal action taken by individuals who have been exposed to asbestos and developed a medical condition attributed to that exposure. These cases are typically brought by individuals who have developed mesothelioma, lung cancer, or asbestosis as a result of exposure to asbestos in their past. In Florida, asbestos litigation is a type of mass tort litigation, meaning a large number of people with similar claims are suing a defendant. In Florida, a court may combine many of the asbestos cases for pre-trial proceedings, including depositions and document discovery. When the cases are ready for trial, the court may order separate individual jury trials. In asbestos cases, the first case to go to trial is known as the “bellwether” case, and its outcome can be used to assess the potential success of future cases. Most asbestos litigation in Florida is brought against product manufacturers and suppliers who put asbestos-containing products on the market without informing buyers of the potential dangers of asbestos. These cases seek to hold the defendants accountable for failing to warn users of the health risks associated with their products and also seek damages for the medical costs associated with treating asbestos-related illnesses. Asbestos litigation is a complex and lengthy process that includes detailed deposition of witnesses and experts, legal arguments, and intensive document discovery. Successful outcomes depend on understanding how the defendants acted negligently and clearly presenting the evidence to the court in support of the plaintiff’s claim.
