How do victims of asbestos-related illnesses prove causation?
Proving causation in asbestos-related illnesses can be a complex process. In order to prove that an asbestos-related illness was caused by negligence in North Carolina, victims must be able to show that the defendant had knowledge of the potential health risks related to asbestos and that the defendant failed to take adequate measures to protect those in the vicinity from harm. The first step is to collect evidence to demonstrate a causal connection between the illness and the defendant’s actions. This can include medical records, expert testimony, and proof that the defendant was aware of the risks of asbestos-related illnesses. The plaintiff must also demonstrate that the defendant had control over the use of asbestos or the environment in which it was used, and that the defendant’s negligence caused the victim’s illness. The plaintiff also has the burden of proving that the defendant’s actions were the direct cause of the illness or injury. This means that the plaintiff must be able to show that the illness or injury would not have happened if it were not for the defendant’s negligence. The defendant must do more than just put the victim at risk; they must be shown to have substantially contributed to the injury or illness. In addition, the plaintiff must prove that the defendant was negligent in their use of asbestos and that their negligence was the proximate cause of the injury or illness. To do this, they must prove that the defendant’s actions were negligent in that they breached a standard of care owed to the plaintiff. Finally, the plaintiff must prove that but for the defendant’s negligence, the illness or injury would not have occurred.
