What are the laws about parking in a designated handicap parking space?

In Texas, parking in a designated handicap parking space is a serious offense which can lead to expensive fines and other penalties. According to the Texas Department of Motor Vehicles, an individual must have a valid placard that identifies them as a person with disabilities in order to park in a handicap parking space. If a vehicle is found illegally parked in a handicap parking space, the owner or operator may be provided with a notice of violation and the vehicle may be towed. In addition to the placard, the Texas Department of Motor Vehicles also requires that the vehicle displays both a temporary or permanent Disabled Person (DP) license plate. In some cases, the placard may be displayed in lieu of a DP license plate. It is important to note that the placard and/or DP license plate must be registered with the Texas Department of Motor Vehicles in order for it to be valid. If an individual is found to be parking in a designated handicap parking space without a valid placard or DP license plate, they may be subject to a fine of up to $500. If the individual is a repeat offender, the fine may increase up to $2,000. Additionally, the individual’s vehicle may be towed and the individual may face legal action. To avoid such penalties, it is important to follow the laws established by the Texas Department of Motor Vehicles and display a valid placard and/or DP license plate when parking in a designated handicap parking space.
