What are the laws about open containers in a vehicle?
In Kansas, open containers of alcohol are not allowed in the passenger area of a motor vehicle, including in the glove box or the center console. This includes having any opened alcoholic beverage, as well as containers that are empty, but had once contained an alcoholic beverage. The law also prohibits any person in the vehicle from consuming an alcoholic beverage. However, there are some exceptions to this open container rule. Passengers can legally possess an open container of alcohol in the living space of a motorhome or camper, as long as the vehicle is parked and the engine is off. A vehicle that is being operated as a taxi or limousine, such as ride-sharing services, are also exempt from this law. The open container does not need to be in an area of the vehicle that is not accessible to the driver. Additionally, passengers in the vehicle are allowed to transport and possess a container of alcohol that is unopened and in its original packaging. Drivers in these vehicles are not allowed to consume any alcohol. Violation of these open container laws can lead to fines of up to $200.
