What is the process for filing an aviation law case?

Filing an aviation law case in Hawaii involves several steps. First, the person filing the claim (the plaintiff) must prepare a complaint. This document identifies the plaintiff, the defendant, and the claims the plaintiff is making against the defendant. The complaint should include as many specifics as possible, such as the location of the incident, the date and time of the incident, the type of aircraft involved, and the nature of the complaint. Second, the plaintiff must serve the complaint to the defendant. This is typically done through a process server who will deliver the complaint to the defendant. Once the defendant has been served, they have twenty days to respond to the complaint with an Answer. Typically, the Answer either admits or denies the claims in the complaint, or makes counterclaims against the plaintiff. Third, the plaintiff and defendant can participate in discovery, a period of time in which both parties share information and documents that are relevant to the case. This can involve the exchange of written questions (interrogatories) or document requests, or even depositions in which witnesses are asked to answer questions under oath. Finally, after the discovery period, the case may be resolved through a settlement agreement or proceed to court, where a judge or jury will decide the outcome. Depending on the complexity of the case and the claims involved, a trial could last several days to several weeks. Ultimately, the court will issue a ruling that determines the outcome of the case.
