What are the rules and regulations surrounding passengers, safety and liability?
In Texas, the aviation statutes and regulations governing passenger safety and liability are found in both federal and state law. Under Federal Aviation Regulations (FAR), passengers are required to wear seatbelts and approved headphones or headsets during takeoff and landing. They must also be informed of the pilot’s certification and the aircraft’s registration and airworthiness. Passengers must comply with safety instructions and must remain seated and buckled during flight operations. The FAA also dictates that aircraft must be maintained and operated in compliance with all applicable regulations. Operators must also have in place a safety and security program, which includes pre-flight inspection and airworthiness checks. In terms of passengers’ liability, operators are required to have liability insurance or must self-insure to cover any damages or injuries that may arise from their aircraft’s operation, including those to persons or property on the ground. Passengers may also assume liability in certain cases, such as if they are found to be in violation of the flight regulations. Lastly, it is important to note that the Texas Department of Public Safety has a few rules governing aviation safety. Flights must be conducted at least 500 feet from any structure, persons, or vehicular traffic and at a horizontal distance of at least 500 feet from any congested area of a city, town, or settlement. These rules are intended to protect passengers and the public from potential hazards associated with aviation operations.
