What are the laws surrounding aircraft accidents and liability?

In Maine, aircraft accidents are governed by the laws surrounding aviation. According to the Federal Aviation Administration (FAA), all aircraft accidents must be reported to the National Transportation Safety Board (NTSB) or a designated agency within 24 hours. The NTSB is then responsible for investigating the accident and determining what happened and why. In the event of an accident, all parties involved may be held liable for damages and costs associated with the accident. In Maine, the owner of the aircraft may be held responsible for the injuries suffered by others in the accident, as well as for repairs or replacement of the aircraft. The pilot of the aircraft may also be held responsible for the accident. In addition, the airplane manufacturer or seller may be held liable if a defect in the aircraft or the parts used in its construction caused or contributed to the accident. In some cases, the person or company responsible for the maintenance of the aircraft may be held responsible as well. Regardless of who is financially liable for the accident, all parties involved in an aircraft accident are obligated to cooperate with the NTSB in the investigation of the accident. Failure to do so may result in the suspension of the aircraft operator’s license. In cases where the aircraft operator is found to be at fault, he or she may face legal action for damages.
