Can I discharge student loan debt through bankruptcy?
In most cases, student loan debt cannot be discharged through bankruptcy in Kansas. Bankruptcy is a way to eliminate certain types of debt, including credit card debt, medical debt, and certain types of unsecured loans. However, student loans are not typically dischargeable. The only way a person might be able to discharge student loan debt in Kansas is if they can prove to the court that paying off the loan would cause an undue hardship. To do this, a person must prove all three of the following factors: 1. The debtor cannot maintain a minimal standard of living if they are paying off the student loan debt. 2. This state of affairs is likely to persist for a significant portion of the repayment period. 3. The debtor has made good faith efforts to repay the student loan in the past. Even if a person proves all three elements, it is still up to the discretion of the bankruptcy court to decide if the student loan debt can be discharged. Most courts are very reluctant to grant this type of relief, so it is very difficult to do. For most people, filing for bankruptcy in Kansas will not relieve them of their student loan debt. However, they may be able to apply for income-based repayment plans or other types of assistance to make student loan payments more manageable.
