How often can I receive a bankruptcy discharge?
In Hawaii, you can usually receive a bankruptcy discharge once every eight years. This means that you can have multiple bankruptcies in a lifetime, but you will have to wait at least eight years between each bankruptcy. Your bankruptcy discharge will wipe out most of your unsecured debts, such as credit card debt and medical bills, while secured debts, such as mortgages and car loans, will not be affected. It is important to understand that just because you are eligible for a discharge, it does not mean that you will be able to discharge all of your debts. Your eligibility for a discharge will depend on the type of bankruptcy you file and the different state laws that apply to it. In addition, you may need to wait longer than eight years after filing for bankruptcy to receive your discharge if the court finds that you obtained credit or incurred debt fraudulently or if you do not complete the required financial education courses. In general, however, if you have met all the requirements of your bankruptcy case, you should be able to receive a discharge from your bankruptcy every eight years.
