How often can I receive a bankruptcy discharge?
In Texas, you can usually only receive a bankruptcy discharge once every eight years. This applies to both Chapter 7 and Chapter 13 bankruptcies. Generally, you cannot discharge the same debts in consecutive bankruptcy filings, so if you receive a discharge in one type of bankruptcy you must wait eight years before you can receive a discharge in the other type of bankruptcy. Note, however, that the exact timing of a discharge in a Chapter 13 bankruptcy depends on the completion of the repayment plan and it is possible to receive a discharge sooner than eight years after the first filing. It is important to note that even if you receive a bankruptcy discharge, some debts may remain. These include student loans, child support, and alimony, as well as certain taxes. It is also important to understand that a bankruptcy filing will remain on your credit report for up to ten years. In addition, creditors may be reluctant to issue you credit or may require you to pay higher interest rates on loans due to a bankruptcy filing.
