What is the role of the bankruptcy judge?
A bankruptcy judge is a court official who oversees bankruptcy cases. In California, they preside over Chapter 7 and Chapter 11 bankruptcy proceedings. The role of the bankruptcy judge is to ensure that the bankruptcy process is conducted in accordance with the law and to ensure that the parties involved in the bankruptcy process are treated fairly and evenly. When a bankruptcy case is filed in California, the judge is responsible for conducting hearings, determining the validity of claims, reviewing documents, and making decisions about the outcome of the case. During the hearing, the judge will evaluate the facts presented by the debtor, creditor, and trustee to make sure that the debtor is meeting the legal requirements of bankruptcy law. The judge will also review any debts owed by the debtor, determine if any assets can be used to pay off creditors, and decide on how the debtor’s assets will be distributed among creditors. If the court decides that the debtor is not able to repay their debts, the judge will issue a discharge in bankruptcy, which eliminates all eligible debts. The judge also ensures that the bankruptcy process is being carried out correctly, that all parties are treated fairly, and that all creditors are paid in full. In addition, the bankruptcy judge can approve agreements between the debtor and their creditors, and make decisions about whether to allow certain requests from the debtor, such as reducing payments or extending the period of repayment.
