What are the restrictions for filing for bankruptcy?
In Nebraska, there are several restrictions to filing for bankruptcy. Firstly, you must be a resident of Nebraska for at least 91 days prior to filing for bankruptcy. Additionally, you must complete pre-filing credit counseling with an approved credit counseling agency. You must produce a certificate of completion of this counseling to the court with your bankruptcy filing. Additionally, your income must fall below the median income for a household of your size. The median income is determined by the Internal Revenue Service and is updated periodically. If your income is above the median income, you may still qualify to file for bankruptcy if you pass a means test. You may also be prevented from filing for bankruptcy if you recently received a discharge in a different type of bankruptcy. Furthermore, if you have filed for bankruptcy in the past, you may be ineligible to file again for four to eight years. Finally, you must have an accurate list of all your debts when filing for bankruptcy. Any incorrect or outdated debts may prevent you from taking full advantage of the bankruptcy process.
