What types of damages are available in a bicycle accident claim?
When filing a claim for a bicycle accident in North Dakota, the potential damages available to the victim of the accident depends on the type of claim and the extent of the injury. Compensatory damages may be awarded based on the negligence or liability of the party responsible for causing the accident. These damages may include medical bills, hospital costs, lost wages and future earning potential, pain and suffering, and emotional distress. Punitive damages may also be available in cases where a defendant acted with extreme negligence or recklessness. In cases involving death, the surviving family members may also be eligible for wrongful death damages. This includes loss of financial support, funeral costs, and damages for mental anguish suffered by survivors. Non-economic damages are also available based on the severity of the accident and injury. These are not intended to reimburse the victim, but rather, to provide them with compensation for the pain and suffering they experienced. Property damages would be available to reimburse the victim for any property that was damaged or destroyed in the accident, such as a bicycle, helmet, or other safety equipment. In some cases, a North Dakota court may also award exemplary damages, also called “punitive” damages. These are intended to punish the person responsible for causing the accident and are only available in cases where extreme negligence or recklessness caused the injury.
