What are the legal restrictions on the use of stem cells in research?
Stem cell research has been a controversial topic in Delaware and throughout the United States. In Delaware, the use of stem cells in research is regulated by state and federal laws that limit the types of stem cells that can be used and the type of research that can be conducted with them. Under Delaware’s laws, research using embryonic stem cell lines derived from discarded embryos created either through in vitro fertilization or other means is allowed. Adult stem cells, however, can only be used in research that has been approved by an institutional review board. In addition, stem cells from any source cannot be used in research that results in an animal embryo being created. At the federal level, the use of stem cells in research is regulated by the National Institutes of Health (NIH). This agency requires that all stem cell research be conducted under the oversight of the NIH Stem Cell Task Force and be approved by an Institutional Review Board. In general, stem cell research within Delaware is subject to both state and federal laws and regulations. In order to conduct research using stem cells, those proposing the research must follow all applicable rules and regulations. This includes obtaining permission from the appropriate institution or organization and following all ethical guidelines associated with the research.
