What is the difference between birth injury and birth trauma?

Birth injuries and birth trauma are two different terms that refer to conditions that can occur during the birthing process. Birth injury is an event that is caused by the actions of another person, like the mother’s doctor, and is considered to be preventable. Birth trauma, on the other hand, is an event caused by something outside of the mother’s and doctor’s control, like a medical emergency or an unexpected event. Birth injuries can be further classified into two types: medical malpractice birth injuries and product liability birth injuries. Medical malpractice birth injuries are caused by the actions of a doctor or other health care professional that fail to follow proper protocols and cause harm to the mother and baby during the birthing process. Product liability birth injuries are caused by the use of defective or malfunctioning medical products or devices used during the birthing process that cause harm to the mother or baby. Birth trauma, on the other hand, is unexpected and unpredictable and is more commonly caused by events like premature labor, complications during labor and delivery, unexpected complications with the mother’s health, or an unexpected injury to the baby. These events can lead to physical or neurological injury to the mother or baby, and can also cause emotional trauma to the family. In New Jersey, both birth injury and birth trauma are taken very seriously, and medical malpractice and product liability claims can be launched in cases where the injury or trauma caused by negligence or a defective product or device.
