What is fetal distress and how can it be used in a birth injury lawsuit?
Fetal distress is a medical term used to describe when the fetus is having difficulty adapting to the environment of the womb, or is not getting adequate oxygen or nutrients during delivery. This is a condition that may develop during the pregnancy or labor and delivery process. Fetal distress can be indicated by a variety of symptoms including low heart rate, low oxygen levels, excessive movement and contractions. Fetal distress can be used as evidence in a birth injury lawsuit in Tennessee if it can be proven that the distress was a result of medical negligence on the part of the doctor. In order to prove this, a medical expert must be consulted to demonstrate that the medical negligence was the direct cause of the injury or distress. For instance, if it can be proven that the doctor did not properly assess the fetal heart rate or oxygen levels, or failed to act on the results of their assessments in a timely manner, this could be considered medical negligence that could directly lead to the distress. In a birth injury lawsuit, the injured party is entitled to compensation for medical bills, pain and suffering, and lost wages due to the injury.
