What is a medical negligence claim and how can it be used in a birth injury lawsuit?
A medical negligence claim is a legal claim that is used when a plaintiff (the injured patient) alleges that a medical provider failed to meet the standard of care in providing medical treatments and/or services. This means that the medical provider did not provide the same level of care that another medical provider with similar experience, knowledge, skill, and/or equipment would have provided under similar circumstances. In a birth injury lawsuit, a medical negligence claim can be used to help establish that the medical provider failed to perform in a way that is considered standard and safe. In order to prove that a medical negligence claim has been violated, the plaintiff must provide evidence that the medical provider performed in a manner that was not in accordance with the standard of care. This can include expert testimony from a medical professional who can provide evidence that the medical provider failed to meet the standard of care. This could include failing to properly diagnose/treat a medical condition, failing to order the correct tests, and/or failing to provide adequate follow-up care. In addition to evidence of medical negligence, the plaintiff must also provide evidence that the alleged medical negligence led to the birth injury. This can include medical records and other evidence that show a direct link between the medical negligence and the birth injury. If successful, the plaintiff can be awarded compensation for their medical bills, lost wages, and/or pain and suffering due to the birth injury.
