What is a class action business litigation lawsuit?

A class action business litigation lawsuit is a type of lawsuit where a group of people, or a “class,” come together to file a civil lawsuit against a business. The class is generally made up of people who have all suffered some type of injury or harm as a result of the same unlawful business practice, product, or service. The class must prove to the court that all members of the class were affected in the same way and that their losses were caused by the defendant’s (the business) wrongful conduct. The class must also show that they are the most efficient way to resolve the dispute. In order to be a part of a class action suit, each member of the class must be given the chance to opt-out or “exclude” themselves from the class if they don’t want to be part of the lawsuit. Once a court approves the class, the individual members of the class will represent the entire class. If the court finds the business liable, the remedies sought by the class may include monetary compensation, changes in the way the business operates, or a combination of both. It is important to note that each class member must comply with any specific procedures the court sets forth in order to be a part of the class and share in any potential monetary rewards. Class action lawsuits can be incredibly effective tools for holding businesses accountable for their wrongdoings and for providing justice for victims in California.
