What is the Equal Credit Opportunity Act?
The Equal Credit Opportunity Act (ECOA) is a federal law that protects consumers in Nebraska from discrimination in credit transactions. The purpose of this law is to ensure that consumer credit is available to all individuals, regardless of race, color, religion, national origin, sex, marital status, or age. The law also prohibits creditors from discriminating against individuals or groups of individuals based on their source of income, or whether they receive income from public assistance programs. Under the ECOA, creditors are prohibited from using any type of discrimination in the credit application process, including asking the applicant about their race, religion, or other protected information. The law also prohibits creditors from refusing to grant credit based on these criteria. Creditors must also provide applicants with information regarding the terms of the credit offered, the maximum amount of credit that may be extended, and any applicable fees and interest rates. The ECOA also requires creditors to provide applicants with a written statement of their rights and the obligations of the creditor within 30 days of applying for credit. This statement must include a notice of the action taken by the creditor regarding the application, as well as how to obtain documentation about the decision. The ECOA prohibits creditors from harassing, intimidating, or coercing applicants into accepting credit terms they do not understand or are not able to meet. Finally, the law also provides consumers with the right to initiate a lawsuit against a creditor, if they feel they have been discriminated against.
