What is the Uniform Electronic Transactions Act?
The Uniform Electronic Transactions Act (UETA) is a law that applies to Oklahoma and most other U.S. states. It applies to transactions involving the use of electronic records and digital signatures. The UETA was enacted in 1999 by the Uniform Law Commission with the goal of promoting the use of digital technology to conduct business transactions. The UETA sets out the legal framework for the use of electronic records as a viable means of conducting transactions and provides the legal framework for the use of digital signatures. The UETA allows parties to determine, in a legally binding manner, which types of electronic records and/or digital signatures can be used to form and perform valid contracts. This is to ensure that parties to a transaction are secure in the knowledge that any valid electronic record or signature used is enforceable. The UETA also provides additional protections to electronic records, which is particularly beneficial for those conducting banking transactions. For example, the UETA gives legal validity to electronic records and records stored in an electronic format, such as email, which can be used to demonstrate the existence of a contract between parties. This means that electronic banking transactions are protected in the same way that paper-based transactions are protected. Overall, the UETA is an important law that provides individuals, businesses, and other entities with a legal framework for conducting transactions electronically. It creates uniformity between the laws in different states and gives individuals, businesses, and other entities the legal security to engage in electronic transactions with confidence.
