What is the Uniform Electronic Transactions Act?

The Uniform Electronic Transactions Act (UETA) is a set of laws that governs the use of electronic transactions in the state of Texas. It is a uniform act that sets standards for the creation and use of digital records in a broad range of business and personal transactions. The uniform act is designed to give legal recognition and acceptance to electronic records, including those stored, generated, and communicated electronically, as valid and reliable records of transactions. UETA provides legal certainty about the validity and enforceability of electronic contracts, records, signatures and transactions. UETA was adopted in Texas in 1999 and covers electronic transactions in the areas of business, commercial, and personal law. In addition, it sets out the rules for the use of electronic messages and digital signatures in commercial transactions. Through UETA, there is assurance that electronic records will be given the same legal effect as paper records. UETA also establishes the rules for creating and using electronic records and digital signatures for legally binding contracts. For example, electronic records that are used for a contract must be sent by an approved commercial service and must contain all the details that are necessary to form a legally binding agreement. Additionally, UETA applies to consumer transactions, so people can be sure that any transactions they make with companies or other entities online are valid and enforceable.
